قانون التصالح لمخالفات البناء
أحد أهم المواضيع التي أثارت الرأي العام في مصر في الأشهر القليلة الماضية هو قانون تصالح مخالفات البناء لأصحاب العقارات المخالفة. و من أكثر القضايا المتواجدة بالمحاكم المصرية نجدها متعلقة بهذه المخالفات و التي تقر علي المخالف أحكام غليظة بالحبس أو الغرامة.
دعونا أولا نستعرض قانون التصالح السابق و تبعياته التي لم تحد من المخالفات و خصوصا مخالفات الأراضي الزراعية و ذلك بسبب عدم توافر المجتمعات العمرانية منذ سنوات و صعوبة استخراج تصاريح البناء في بعض الأحياء, فما كان من الحكومة المصرية الا حل المشكلة على محورين:
الأول و هو توفير مجتمعات عمرانية جديدة وهو ما شهدناه من طفرات إنشائية في بعض المدن الجديدة الموجهة لأصحاب الطبقة المتوسطة و تحت المتوسطة و توفير 50 مليار جنيه لمبادرة التمويل العقاري في 2019 لتسريع عملية أشغال هذه الوحدات.
و الثاني و هو قانون التصالح الجديد مع المخالف مقابل رسوم مادية بدلا من قرارات الازالة.
سنشرح قانون التصالح لمخالفي البناء بطريقة مبسطة, و لكن دعونا أولا نستعرض مخالفات البناء التي لا يجوز التصالح فيها:
بناء على ارض زراعية
- تغيير الاستخدام للمناطق الصادرة لها مخططات تفصيلية ما لم توافق الجهة الإدارية
- التعدى على خطوط التنظيم وحقوق الارتفاق ما لم يُحل الأمر مع جهة الاختصاص
- البناء على أراضٍ خاضعة لقانون حماية الآثار ونهر النيل
- البناء خارج الحيز العمرانى عدا الاستثناءات الواردة بالقانون
- مخالفات المبانى ذات الطراز المعمارى المتميز
- تجاوز قيود الارتفاع المقررة من الطيران المدنى أو متطلبات شؤون الدفاع
- الإخلال بالسلامة الإنشائية
- البناء على أملاك الدولة ما لم يُقدم طلب لتقنين الوضع
- تغيير الاستخدام للمناطق الصادرة لها مخططات تفصيلية ما لم توافق الجهة الإدارية
البرلمان أقر “قانون التصالح في مخالفات البناء”
هذا القانون الذي يسمح لأي مواطن التصالح مع الدولة بدفع الرسوم المقررة بعد مخالفته سواء كان العقار غير حاصل علي التراخيص اللازمة أو قام المخالف بالبناء و التعدي علي الأراضي الزراعية. و يسمح هذا القانون بدخول المرافق لهذه الوحدات بعد تنفيذ العقوبات.
هنحاول نشرح لقرائنا الموضوع عن طريق طرح بعض الأسئلة المكررة و اجاباتها. فقم بالتركيز معانا في أهم عشرون سؤال:
ما أبرز المخالفات المشمولة في قانون التصالح ؟
- البناء بدون ترخيص
- مخالفة بنود الترخيص فيما لا يُؤثر على السلامة الإنشائية
- تغيير الاستخدام من سكنى إلى تجارى أو غير ذلك
- عدم مطابقة اشتراطات التخطيط السارية
- مخالفة الرسوم المعمارية والإنشائية
- تعلية أدوار مخالفة لعدد الطوابق المحدد

لماذا لم تترك الدولة الأوضاع السابقة ووضعت قانون التصالح؟
خلينا نتكلم بصراحة, هل الحكومة مستفيدة من التكلفة العالية في حصر المخالفات و تكاليف قرارات الازالة؟ لا طبعا.
طيب هل الحالة المعيشية مستقرة لجميع المخالفين من خدمات و مرافق؟ أكيد لأ
مبادرة الدولة هي للحد من التكلفة العالية لتوصيل الخدمات للعقارات المخالفة.
كيف تبدأ اجراءات التصالح ؟
بحد أدنى 50 جنيه للمتر وحد أقصى 2000 جنيه للمتر حسب المستوى العمراني والحضاري، بإمكانية التقسيط.
ستتشكل لجان في كل محافظة مهمتها التسعير و تقسيم المحافظات إلى شرائح على حسب المنطقة
– ماذا لو اللجنة وافقت على طلب التصالح أو رفضته، ماذا سيحدث؟
– لو في موافقة، سيصدر قرار بقبول التصالح، وسيكون أمامك فرصة 60 يوم لسداد مبلغ التصالح.
– أما لو طلبك أترفض، أو تأخرت في سداد قيمة التصالح عن 60 يوم، فأي إجراءات كانت ضدك سواء قضية أو قرار إزالة ستعود من جديد.
التظلم في حالة عدم القبول: ستقوم بتقديم تظلم خلال 30 من تاريخ إخطاره بالرفض، ومن المقرر أن اللجنة تنظر فيه خلال 90 يوم.
لن يصدر القرار النهائي بالتصالح إلا “بعد طلاء واجهات العقارات” كاملة التشطيب “مع استثناء المباني في القرى من هذا الشرط”.
شروط وإجراءات قانون التصالح في مخالفات البناء؟
طلب تصالح عن مخالفات البناء
1- يتم تقديم الطلب التصالح وفقا للحي أو الجهاز التابع له الوحدة المخالفة شاملاً الملف الهندسي والمستندات المطلوبة .
2- سداد قيمة رسم الفحص من 1000 جنية حتى 5000 جنيه .
3- دراسة الطلبات لإصدار قرار بالقبول أو الرفض.
4- تحديد قيمة التصالح حسب المنطقة وسعر المتر فيها، والتأكد من طلاء كامل الواجهات .
5- دفع قيمة التصالح، والتي تبدأ بـ 50 جنيها للمتر وصولاً إلى 2000 جنيه للمتر وفقا للجنة التصالح.
6- الحصول على شهادة من اللجنة بطلب التصالح لوقف أي دعاوى متعلقة بالمخالفات أو أحكام صادرة بشأنها صلاحيتها 3 شهور .
7- يقوم صاحب العقار باستيفاء حافظة مستندات تضم أوراق العقار ونماذج أخرى، ثم يصدر قرار قبول أو رفض التصالح، وفي حال التصالح سداد القيمة في المخالفات والحصول على قرار نهائي .
8- يمكن إلى المتصالح تقسيط قيمة التصالح على 3 سنوات عباره عن 3 أقساط سنوية بفائدة صفرية، ودفع مقدم 25٪ من القيمة الإجمالية بعد خصم ما تم دفعه من جدية التصالح .
9- سداد قيمة التصالح في المخالفات حال قبول الطلب ويحصل بموجبه المخالف على قرار نهائي بتسوية المخالفات.

تقنين أراضي وضع اليد؟
تنفصل حالات وضع اليد والتعدي على ممتلكات الدولة الى مخالفتين و لذلك فان طلب التصالح على الأرض نفسها من الجهة أو الجهاز التابع لها منفصل عن طلب التصالح لتقنين العقار نفسه لاكسابه الشكل القانوني.

ولكن ناشدت محافظة القاهرة المواطنين بضرورة قيام مقدمي طلبات التصالح على مخالفات البناء بسرعة سداد مبلغ الـ 25% المقررة جدية تصالح لحين السير فى باقى الإجراءات وإلا أعتبر الطلب المقدم للتصالح لاغيًا.
